My family has custody of my cousin so I have heard a lot about these situation through courts- unless there is a whole lot of evidence saying that your husband didn't do anything to the kids, then the courts tend to want to side with the mother by default. If this winds up in court then I would do what it took to prove your case and that your husband didn't hurt then kids.

I am very familiar with this situation as my family went through a similar thing. Unfortunately an EX can do this kind of thing. If you're lucky you will end up before a judge who takes it with a grain of salt. I don't know where you live but in Canada you will have to talk to social workers. they will probably talk to you, your husband and maybe even some character witnesses. They will then determine if there is anything here. Most times they determine that it is a ';Custody thing'; and it is dismissed especially if there is no recorded history of abuse and no reliable witness to it. They may talk to the kids as well.The good thing is that if things are dismissed you will then have a point in your favour. She will have a record of trying to turn a child against a parent. Most times this doesn't go over well with a judge.Unfortunately though there are still some old school judges that believe that a bad mother is better then no mother and all a kid really needs from a father is a monthly cheque. I hope things work out for you. You're in for a long road with this. It took nearly five years for things to get worked out in our case. Now SHE has supervised visitation. Good Luck.
